In case law, it is disputed whether liability for incorrect delivery must be assessed according to article 17 of the Contract for the International Carriage of Goods by Road Convention or according to general rules of transport law. The Maritime and Commercial Court recently assumed that an obligation to ensure that goods are delivered to the right person exists, but did not indicate that any strict liability applies in relation to the carrier's duty to investigate these matters.
